This website belongs to the Aquae Foundation (hereinafter AQUAE), a private foundation of Spanish nationality, domiciled in Madrid, Paseo de la Castellana 259, floor 31 Torre de Cristal, with NIF G86426574 and registered in the Registry of Foundations of Madrid, owner of the ACT4WATER.ORG website.
Access to and use of the website confers on the user the status of “user” who fully and unreservedly accepts these general conditions, as well as the specific conditions that, where appropriate, complement, modify or replace the general conditions in relation to certain services and conditions of the website.

GENERAL CONDITIONS OF USE OF THE WEBSITE

OBJECT

These General Conditions regulate the use (including access, creation, creation, editing, modification and deletion) of this Act4Water website, including the content and services made available on it. Aquae Foundation adopts reasonably adequate security measures to detect the existence of viruses, however, the user should be aware that the security measures of computer systems on the Internet are not entirely reliable and, therefore, Aquae Foundation can not guarantee the absence of viruses or other elements that may cause alterations in the user’s computer systems or electronic documents and files contained therein.

INDUSTRIAL AND INTELLECTUAL PROPERTY RIGHTS

All industrial and intellectual property rights as well as all information contained on the website (images, graphic designs, source code, design, navigation structure, databases and any other content that appears on it) are owned by Aquae Foundation or holds sufficient rights for use.
The exploitation rights on this website and any of its contents, elements and, in particular, the rights of use, exploitation, distribution, transformation and public communication belong at all times on an exclusive basis, for the entire duration provided by law with respect to such rights of intellectual property and worldwide Aquae Foundation, including any improvement, adaptation, translation, improvement of any of its contents, elements and other materials created, edited and / or modified by the user. The user may not use Aquae Foundation registered trademarks, trade names, designs, know-how or any other distinctive sign of Aquae Foundation without the express prior consent of the same.
The user may not modify or reproduce, in whole or in part, this information without the express prior consent of Aquae Foundation. By way of example but not limitation:

The user is not authorized to delete, evade, manipulate the copyright and other data identifying the rights of the Achae Foundation, as well as any protection mechanisms.
The user is not authorized to disassemble, decompile or invert the databases in which the information on the website is stored. All information on the website is protected by copyright. The unauthorized use of the information contained in this website, its resale, as well as any breach of the Intellectual or Industrial Property rights of Fundación Acae, will give rise to the legally established responsibilities. Fundación Aquae is not responsible for any damages arising from the use of the contents of its website. In particular, Aquae Foundation is not responsible for the contents or the state of the links contained in this website that may lead the user to other sites and web pages operated by third parties. Fundación Aquae is not responsible for the content or status of these sites and web pages. Access to them through this website does not imply that Aquae Foundation recommends or approves their contents. Aquae Foundation is not responsible for damages of any kind caused by deficiencies in the service of its server center, or communication networks, or problems resulting from malfunctions or use of non-optimized versions of browsers. Both access to the website and the use that may be made of the information contained therein is the sole responsibility of the user. Aquae Foundation is not responsible for any consequence or damage that may arise from such access or use of information. Aquae Foundation does not offer or market by itself and/or through third parties the information, content and services available on the Linked Sites, nor does it approve, supervise or control in any way the content and services as well as any material of any nature existing in the same, with the user assuming exclusive responsibility for navigation through the same.
The existence of Linked Sites does not presuppose in any case the formalization of agreements with the responsible or owners thereof, nor the recommendation, promotion or identification of Aquae Foundation with the statements, content or services provided.

APPLICABLE LAW AND JURISDICTION

These general conditions shall be governed by Spanish law. Aquae Foundation and the user, expressly waiving any other jurisdiction that may apply, are subject to the jurisdiction of the Courts and Tribunals of Madrid, for any questions which may arise or actions arising from the provision of the website service and its services and content and the interpretation, application, enforcement or breach of the provisions herein.

Object

These Conditions regulate access to the Contents and all services and functionalities offered by AQUAE through ACT4WATER.ORG, including article comments, Blogs, chats, forums and any other, as well as the use of the same by the Users (those who access, use and participate in the services and activities that take place on the AQUAE website will have the status of user).
The access and use of the Contents and the AQUAE website implies the acceptance of the Conditions in force.

Usage

The User agrees to use the features available on ACT4WATER.ORG in accordance with the Law and these Conditions. Refraining from making use of the functionalities of the AQUAE website for purposes or effects that are unlawful or contrary to the provisions of the Conditions.

The User agrees and is aware that in the services of comments, Blogs, forums, sending information through forms, as well as any other that involves the publication of opinions of the Users, advertisements, chain e-mail messages or any other content that is not related to the issues indicated in the service in question are not allowed. The User agrees not to use the functionality of the website of AQUAE to publish content or messages that defame or insult, or contain false information, which is inappropriate, abusive, pornographic, threatening, damaging public image or the privacy of others or violate any law; by way of example but not limited to the dissemination is expressly prohibited through the functionality provided by ACT4WATER.ORG of information, photographs, sound files and / or image, data or any other content that:

AQUAE reserves the right to deny the use of the services and functionalities made available on the Web site and to remove the information, data, files and other Content disseminated or made available to third parties through any of these means, at any time and without prior notice to those Users who violate these Conditions. AQUAE may remove those messages that it considers inappropriate, out of context or that have no continuity with the debates, forums or topics in question.

Intellectual and industrial property rights

This Web site is governed by Spanish law and by national and international legislation on intellectual and industrial property.

Likewise, the exploitation rights over this Web site and any of its elements and, in particular, the rights of use, exploitation, distribution, transformation and public communication, shall belong, exclusively, for the maximum period of time legally established and for the whole world, to AQUAE; including any improvement, adaptation, translation and improvement of any of its contents.

The user may not use AQUAE’s registered trademarks, logos, trade names, designs, know how, as well as any other distinctive sign of AQUAE without the prior and express consent of AQUAE.

The User shall refrain from using any system or device capable of accessing or altering the configuration of the Web site or its security system.

AQUAE cannot guarantee the reliability, usefulness or veracity of the Contents or information provided through the Web Site, nor the usefulness or veracity of the documentation made available by the Users through the Web Site.

AQUAE declares that it adopts reasonably adequate security measures to detect the existence of viruses, however, the User must be aware that the security measures of computer systems on the Internet are not entirely reliable and that, therefore, AQUAE cannot guarantee the non-existence of viruses or other elements that may cause alterations in the User’s computer systems or in its electronic documents and files contained therein.

AQUAE does not guarantee the availability and continuity of the operation of the website. Nor does AQUAE guarantee the usefulness of the functionalities of the same for the performance of any particular activity, nor its infallibility.

AQUAE assumes no liability for damages of any nature that may arise from the lack of availability or continuity of the operation of the website, and access to the Content and service suspensions and, in particular, but not exclusively, to the temporary limitations on access to the various web pages of the commentary service. AQUAE may at any time temporarily or permanently suspend any Service.
